Zoning protects areas from incompatible land uses and establishes standards for development. A zoning by-law amendment is a by-law passed by Council. Since the Zoning By-law implements the Official Plan, a zoning by-law amendment must conform to the Official Plan. If it does not, you might need an official plan amendment before applying for a proposed Zoning By-law amendment.
A pre-consultation form submitted to staff for review will be required prior to applying for a Zoning By-law Amendment. This process assists staff in determining exactly what will be required for the parcel of land. Once the pre-consultation process is complete, you may complete the Zoning By-law Amendment Application.
Your re-zoning application will be reviewed by planning staff to determine that it is complete. You will be advised within 30 days of the application having been submitted as to whether or not it is complete. If the application is not complete, we will let you know what information is missing so you can provide that material.
Once your application is complete, staff will process the application and send out a notice of a public meeting that will be provided to any property within a 120 metre radius of the property. Notices will also be circulated to the relevant agencies 20 days prior to the hearing date. The notice and information submitted with it will be available to the public upon request.
Our staff will prepare a report with a recommendation to be considered at the public hearing before Council. As the applicant, you'll have an opportunity to present any further details or information at the public meeting. The public is also invited to submit comments or speak on behalf of the application by submitting a request in writing to the Clerk or Planning staff.
After the meeting, a decision will be circulated to the owner and agent as well as the County of Peterborough.
If the Zoning By-law Amendment has been approved, a 20 day appeal period will be available for any parties wishing to appeal the decision to the Local Planning Appeal Tribunal.
